Terms of Service

1. Agreement to Terms

By subscribing to, creating an account on, or accessing FieldControl ZA (the "Service"), you ("Customer" or "User") enter into a legally binding master software-as-a-service agreement with TVB Network (Pty) Ltd ("TVB Network", "we", "us").

2. Service Description & Cloud Workspaces

FieldControl provides field service dispatch, GPS geofenced mobile clocking, truck stock inventory ledgers, BCEA shift timesheets, subcontractor compliance auditing (COIDA & B-BBEE), digital OHS safety checklists, and Paystack invoicing integrations. Workspaces operate in multi-database functional shards hosted on Google Cloud BigQuery.

3. Geofenced Location Tracking Disclosure

Customer acknowledges that FieldControl collects GPS coordinates from field workers' mobile devices at the precise instant of clock-in, clock-out, and job status milestones to verify proximity to designated job site hubs (150-meter radius). Customer is solely responsible for informing its employees and obtaining any consents required by South African labor law and POPIA.

4. OHS Statutory Checklists Disclaimer

FieldControl provides digital checklists and Lockout/Tagout (LOTO) audit records to assist with Occupational Health and Safety (OHS Act) compliance. The Service does not provide formal legal, engineering, or statutory safety certifications. Customer remains fully responsible for on-site physical workplace safety and certified supervisor verification.

6. Data Ownership & Intellectual Property

Customer retains 100% ownership of all job cards, work order customer data, inventory ledgers, employee timesheets, and contractor records uploaded to the Service. TVB Network retains all proprietary rights, trademarks, vector icons, software architectures, and algorithms.

7. Limitation of Liability

To the maximum extent permitted by South African law, TVB Network shall not be liable for any indirect, incidental, punitive, or consequential damages arising out of load shedding telecommunications disruptions, third-party network outages, or device GPS hardware inaccuracies.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be submitted to the non-exclusive jurisdiction of the High Court of South Africa, Gauteng Division, Pretoria.
